Terms of Service

1) Acceptance of Terms

By downloading, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

2) Eligibility

You must be at least 13 years old to use the Services. If you are under the age of majority in your jurisdiction, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf as required by applicable law.

3) Important Medical Disclaimer

The Services are designed for informational and wellness tracking purposes only.

The app is not a diagnostic tool and must not be used as a method of contraception or to facilitate conception.

Predictions, cycle estimates, and insights are informational only and are not a substitute for professional medical advice, diagnosis, or treatment.

Always consult a qualified healthcare provider for health concerns and before making medical or reproductive decisions.

If you believe you have a medical emergency, contact emergency services immediately.

4) Account Registration and Security

• You may sign in using supported authentication methods (for example email/password, Google, Apple, or anonymous/guest mode where available).
• You are responsible for maintaining the confidentiality of your credentials and for activities under your account.
• You agree to provide accurate information and keep it reasonably current.

5) License to Use the Services

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial use.

All rights, title, and interest in the Services, including trademarks, logos, and software, remain the exclusive property of GetMyMood Inc. or its licensors.

6) Your Content

You retain ownership of content you submit (for example cycle entries, symptoms, and notes). You grant us a limited license to host, process, transmit, and display that content solely to provide, maintain, and improve the Services, and as otherwise permitted by our Privacy Policy and applicable law.

7) Prohibited Conduct

You agree not to:

• Attempt unauthorized access to accounts, systems, or data.
• Interfere with security, performance, or operation of the Services.
• Use the Services for unlawful, abusive, or fraudulent activity.
• Reverse engineer or attempt to derive source code except where permitted by law.
• Upload malware or other harmful code.

8) Ads, Third-Party Services, and Platforms

The mobile app may display ads on supported platforms. We also rely on third-party providers (including Firebase/Google services and app distribution platforms) to operate core functionality. Your use of third-party features may be subject to those providers' terms and policies.

9) Paid Features and Subscriptions

Certain paid features, subscriptions, or entitlements may be offered now or in the future. If applicable, pricing, renewal, and cancellation terms will be presented before purchase. App store purchases are managed by the relevant app store billing system and its terms.

10) Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect and process information.

11) Suspension and Termination

You may stop using the Services at any time. You may delete your account in-app where available, or request an emailed confirmation link at /delete-account if you no longer have app access. We may suspend or terminate access if you violate these Terms, create risk for other users, or if required by law.

12) Disclaimer of Warranties

To the maximum extent permitted by law, the Services are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

13) Limitation of Liability

To the maximum extent permitted by law, GetMyMood Inc. and its affiliates, officers, employees, and service providers are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, goodwill, or business interruption arising from or related to your use of the Services.

In no event will our aggregate liability exceed the greater of (a) the amounts you paid us in the twelve months preceding the claim, or (b) fifty Canadian dollars (CAD $50).

Where liability cannot be excluded by law, it is limited to the minimum extent permitted by law.

14) Indemnity

You agree to defend, indemnify, and hold harmless GetMyMood Inc. from claims, liabilities, damages, and expenses (including reasonable legal fees) arising from your misuse of the Services, your content, or your violation of these Terms or applicable law.

15) Governing Law and Venue

These Terms are governed by the laws of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. You agree that courts located in Toronto, Ontario will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Services, except where prohibited by applicable consumer protection or mandatory law of your jurisdiction.

16) Changes to These Terms

We may modify these Terms from time to time. Updated Terms will be posted at /terms with a revised "Last updated" date. Continued use of the Services after updated Terms become effective constitutes acceptance of the updated Terms.

17) Force Majeure

We are not liable for delays or failures in performance caused by events beyond our reasonable control, including natural disasters, government actions, pandemics, or service provider outages.

18) Assignment

You may not assign or transfer these Terms or any rights under them. We may assign our rights and obligations to an affiliate or successor in connection with a merger, acquisition, or sale of substantially all of our assets.

19) General

If any provision of these Terms is held to be unenforceable, the remaining provisions will continue in full force and effect.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and GetMyMood Inc. regarding the Services and supersede all prior agreements on this subject.
